1. Scope and agreement
These terms apply when you use this website or engage Softkernelgrid for app analytics consulting. A signed proposal or statement of work may add project-specific terms; where there is a conflict, that signed document takes priority.
2. Proposals and services
Website descriptions are general information, not a binding offer or guarantee of a particular experiment outcome. Scope, fees, milestones, dependencies and deliverables are confirmed in writing before work begins.
3. Client responsibilities
You are responsible for lawful access to data, accurate background information, timely feedback and decisions, and appropriate security permissions. You must not provide personal data that is unnecessary for the agreed analysis.
4. Fees and payment
Fees, applicable Malaysian taxes, invoicing schedule and payment due dates appear in the accepted proposal. Overdue undisputed sums may pause work after reasonable notice.
5. Intellectual property
Each party retains its pre-existing materials and methods. After full payment, you may use project deliverables for your internal business purposes. Reusable analytical methods, templates and general know-how remain ours; your confidential information remains yours.
6. Confidentiality and data
Both parties must protect confidential information and use it only for the engagement. Data handling requirements, access duration and deletion arrangements may be specified in the project agreement.
7. Analytics decisions
Analysis supports, but does not replace, your commercial, legal and product judgment. Estimates are subject to data quality, assumptions and uncertainty. We do not guarantee revenue, uplift or statistical significance.
8. Liability
To the extent permitted by Malaysian law, neither party is liable for indirect or consequential loss. Any aggregate liability will be limited as stated in the project agreement. Nothing excludes liability that cannot lawfully be excluded.
9. Termination
Either party may terminate according to the signed proposal, including for material breach not remedied after notice. Fees remain payable for completed work and committed non-cancellable costs.
